These Terms of Service explain the rules for using the Darevix website and interacting with our content, enquiry forms, and product information. They are designed to be readable and practical. 1. Acceptance and eligibility

By accessing or using this website, you agree to these Terms of Service. If you do not agree, do not use the site. These Terms apply to all visitors, including people who read our content, browse our product pages, or submit an enquiry through /contact/.

Minimum age: You must be at least 16 years old to submit an enquiry form or otherwise provide personal data to us through the site. If you are under 16, a parent or guardian should contact us on your behalf. We do not knowingly collect personal data from children under 16.

If you use this site on behalf of an organisation, you confirm that you have authority to accept these Terms on that organisation’s behalf.

2. Service description

Darevix operates an Irish organic juice farm and provides information about our ingredients, products, benefits, and reviews through this website. The site also enables you to contact us for enquiries relating to availability, farm pickup, bulk or event orders, partnerships, and general questions.

The website content is provided for general information. Product descriptions, seasonal availability notes, and ingredient sourcing information may change without notice. While we aim to keep content accurate, farming and supply conditions can affect what is available and when.

The site does not create a binding purchase contract on its own. Where we discuss packs or availability, those details are indicative until confirmed by us in writing (for example, by email) after your enquiry. If we agree an order, we will confirm key details such as quantity, pricing, pickup or delivery arrangements if applicable, and any relevant product notes.

3. User obligations

You agree to use the website lawfully and respectfully. You must not use the website in a manner that could damage the site, interfere with its normal operation, or prevent others from using it.

When you submit an enquiry, you agree that the information you provide is accurate and relates to a legitimate request. You should not submit false contact details, impersonate another person, or attempt to mislead our team.

If you communicate with Darevix by email after using the site, you agree to maintain respectful and non-abusive communications. We may stop responding to communications that are threatening, abusive, or harassing.

You must not attempt to gain unauthorised access to any part of the site, server infrastructure, or data. You must not probe, scan, or test the vulnerability of the site or any network connected to it.

4. Intellectual property

The website and its contents, including text, layout, logos, brand elements, graphics, and code, are owned by Darevix (or licensed to us) and are protected by intellectual property laws. This includes the Darevix name and visual identity.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the website for your personal, non-commercial purposes, such as learning about our products and contacting us.

You must not copy, reproduce, distribute, publicly display, sell, lease, create derivative works from, or otherwise exploit website content for commercial purposes without our prior written permission. Short quotations for genuine review or commentary may be permitted where allowed by law, provided you credit Darevix and do not misrepresent the source.

5. Prohibited activities

You must not, and must not attempt to, do any of the following:

  • Use the site for unlawful purposes or in violation of any applicable regulations.
  • Scrape, crawl, or use automated tools to extract data or content from the site without permission.
  • Reverse engineer, decompile, or attempt to discover source code or underlying components beyond what is delivered in the browser.
  • Introduce malware, viruses, or other harmful code, or attempt to bypass security features.
  • Send spam or unsolicited promotional messages to Darevix via the contact form or published email address.
  • Impersonate any person or entity, or misrepresent your affiliation with Darevix.
  • Infringe the rights of others, including intellectual property rights or privacy rights.
  • Interfere with or disrupt the integrity or performance of the site or related systems.

If we believe prohibited activity has occurred, we may restrict access to the site and may cooperate with law enforcement where required.

6. Disclaimer of warranties

The website and its content are provided on an “as is” and “as available” basis. We do not guarantee that the site will be uninterrupted, error-free, or secure at all times, or that defects will be corrected immediately.

We do not warrant the accuracy, completeness, or reliability of any content on the site. Content may become out of date, particularly where it relates to seasonal availability, harvest timing, or supplier deliveries.

Nothing in these Terms limits any rights you may have under applicable consumer protection law that cannot be excluded. Where warranties cannot be excluded, they are limited to the extent permitted by law.

7. Limitation of liability

To the maximum extent permitted by law, Darevix will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the site. This includes loss of profits, loss of business opportunity, loss of data, or reputational harm, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, Darevix’s total liability for any claim arising out of or relating to these Terms or your use of the site is limited to the lower of: (a) the amount you paid to Darevix in the 12 months preceding the event giving rise to the claim, or (b) EUR 100.

This limitation of liability does not apply where liability cannot be limited under Irish law, including for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

8. Indemnification

You agree to indemnify and hold harmless Darevix, its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to:

  • Your breach of these Terms.
  • Your misuse of the site or content.
  • Your violation of any law or the rights of a third party.

We may assume the defence of any matter subject to indemnification, and you agree to cooperate with us in that defence.

9. Third-party links

The site may reference third-party services or resources for context, such as tools used to operate or measure website performance. If we provide any external links in the future, they are provided for convenience only.

Darevix is not responsible for the content, policies, or practices of third-party websites or services. Your use of third-party services is at your own risk and subject to their own terms and privacy policies.

10. Privacy

Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains what data we collect, why we collect it, how long we keep it, and how you can exercise your rights under GDPR.

If you submit an enquiry, you should only provide the information necessary for us to respond. Avoid including sensitive personal information in free-text fields.

11. Governing law and dispute resolution

These Terms are governed by the laws of Ireland, without regard to conflict of law principles. The courts of Dublin, Ireland have exclusive jurisdiction to resolve any dispute arising out of or relating to these Terms or the website, subject to any mandatory legal rights you may have as a consumer.

Informal resolution: Before starting formal legal proceedings, you agree to contact us and describe the issue so we have an opportunity to resolve it. Unless urgent relief is required, both parties agree to attempt informal resolution for at least 30 days after the initial notice is given.

12. Termination

We may suspend or terminate access to the website (or parts of it) immediately and with or without notice if we reasonably believe you have violated these Terms, attempted unauthorised access, or used the site in a way that could cause harm to Darevix or others.

The following sections survive termination: Intellectual property, Prohibited activities, Disclaimer of warranties, Limitation of liability, Indemnification, Governing law and dispute resolution, and any other provisions which by their nature should survive.

13. Modifications to these Terms

We may update these Terms from time to time to reflect changes to the website, our operations, or legal requirements. Changes become effective 14 days after we post the updated Terms on this page, unless a shorter period is required by law or the changes are minor and do not materially affect your rights.

If you continue to use the website after the effective date, you are considered to have accepted the updated Terms. If you do not agree to the updated Terms, you should stop using the website.

The “Last Updated” date at the top of this page indicates the most recent revision.
